Cybersecurity and Privacy: Practical, Legal and Ethical Considerations Before and After a Law Firm is Hacked

This program will consider the legal, practical, and ethical considerations implicated when a law firm suffers a data breach. Topics to be covered include: statutes and common law duties governing data security and privacy; current trends in mitigating data privacy litigation risk; how a firm should consider preparing and responding to a breach; what a firm may do to preserve evidence; and the ethical duties related to cyber security, including guidance provided by the various bar associations and emerging law from cyber security breaches. The presentation will also address how considerations change when a breach has a non-U.S. competent, including under the EU's General Data Protection Regulation, and the potential implications of Brexit.
