This program will highlight issues that may arise in the
increasingly complex area of electronic discovery and seeks to
elucidate how adverse parties can achieve positive results,
including through cooperation in discovery. The program, co-chaired
by Judge Shira Scheindlin and Ariana Tadler, will present three
stages of a hypothetical litigation in which both parties have
prepared Rule 26 initial disclosures. Issues encompassed by the
program will include the scope of preservation, undue cost and
burden and cost-shifting, backup tapes, and accessible versus
non-accessible sources.
