On February 25, 2020, Pupillage Group 3 presented, "Getting to a Resolution that Makes
Business Sense: Conducting an Effective Mediation and Tips for Drafting and Enforcing IP Settlement Agreements."
 Group 3 provided an overview of tips for a productive mediation, followed by offering small fact patterns to demonstrate aspects of successful mediation including confidentiality requirements, client management, legs and ethical guidelines. Next, they provided settlement tips including to clarify the scope of up rights granted, patent marking, most favored nation clauses, and contracting around patent exhaustion. Finally, Group 3 offered fact patterns and asked members to decide whether a court would grant a motion to enforce the settlement based upon the facts presented.

January 14, 2020

On January 14, 2020, Pupillage Group 6 presented, "IPRs in Flux: SAS, Arthrex and beyond." First, Group 6 discussed generally the statutory structure, process, and benefits of IPR proceedings as contemplated by Congress and the initial PTO rules. Next, Group 6 presented seperately the SAS and Arthrex decisions.  During the discussion, Group 6 engaged members to discuss whether IPRs have proven successful based upon Congress's intent, and whether members had practice pointers based upon the SAS and Arthrex decisions.

November 19, 2019

On October 19, 2019, Pupillage Group 5 presented, "Right to Trial by Jury in Patent Cases." First, Group 5 presented a primer on the Seventh Amendment.  Then members were offered hypotheticals and asked to decide whether a jury trial right was preserved in a patent infringement case based upon the facts in the hypothetical.

October 15, 2019

On October 15, 2019, Pupillage Group 1 presented Alice in 101-derland.  Their presentation included challenging members to determine whether certain patent claims were ineligible under the Alice/Mayo test. All members who wore a a Halloween costume were rewarded with Markey Points, which went towards their pupilage group's totals.

September 17, 2019

We held our Kick Off Meeting and Social on September 17, 2019. We enjoyed drinks, appetizers, dinner, and each other's company. Our new President, David Stein, made welcoming remarks. Our Program Co-Chair, Glen Liu, explained the Amazing Markey Race, the pupilage group team-building component to this year's program. Looking forward to another great year!
