Taking a Swim in the Legal "Shark Tank"
Pupilage group 1 presented at
the November 12th meeting. There were four discrete segments
to their program. The first explored whether, and to what
extent, a Virginia lawyer may assist a pro se litigant by
reviewing, editing, and even ghostwriting documents without making
an appearance in the case. The second involved the authority of a
court to control abusive conduct during discovery. The third was an
evaluation of whether a plea agreement in a criminal case may
include a waiver of the defendant's right to later claim
ineffective assistance of counsel. The last involved contacts
between lawyers and family members in a domestic-relations case,
specifically including discussions between a lawyer for a divorcing
parent and one of the minor children of the parties.
