Privacy in the Digital Age

This panel will cover aspects of digital privacy that are
relevant to those who practice criminal law or who conduct
internal investigations even in a non-criminal context. U.S.
Magistrate Judge Justin Anand will discuss the state of digital
privacy in the criminal context, focusing on the ever-evolving law
governing searches and seizures of electronic devices and
cloud-based data. Doug Gilfillan, partner at Kilpatrick Townsend,
and Mike Caplan, partner at Caplan Cobb, will discuss data privacy
and electronic searches in the private sector, with a special
emphasis on employee electronic devices used for business purposes,
and how to advise clients on lawfully accessing and using this
potential source of information when conducting internal
investigations and in other contexts. Lynsey Barron, who is the
Compliance, Investigations, Privacy, and Cybersecurity counsel for
United Parcel Service (UPS), will convene the panel.
